Terms of Service
1. Overview
FunnyFace is an AI photo generation and editing app. It lets you upload a photo, choose a style, generate a new image, keep results in the app, and download them to your device.
In this document, "FunnyFace", "we", "us", or "the Service" means the FunnyFace mobile app together with the servers, website, features, and related services behind it, operated by an individual developer:

By downloading, accessing, or using FunnyFace, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 16 years old to use FunnyFace. FunnyFace is not designed for and is not directed at children under 16, and we do not knowingly allow accounts for people under that age.
FunnyFace is offered in selected countries only. The Service is not offered in, and is not intended for users located in, the European Economic Area, the United Kingdom, or Switzerland.
3. Accounts, Sign-In, and Acceptance
You can sign in to FunnyFace with Apple, Google, or email. Authentication is handled through Firebase. You are responsible for keeping your device and sign-in credentials secure, and for activity that takes place in your account.
When you create an account, you must confirm that you accept these Terms of Service and that you have read the Privacy Policy. We record the date, time, and document version of that acceptance. Without it, no account is created.
Processing the photos you upload in order to generate new images is what the Service does. It is the thing you are asking us to do when you use FunnyFace, not a separate setting you switch on, and we do not ask you to agree to it separately: there is no version of this app in which you decline it and still have something to use. What we do with an uploaded photo is set out in section 6 below and in sections 3 to 6 of the Privacy Policy. The choice that stays yours, every time, is whether to upload a particular photograph at all.
Verifying your email address earns you credits where we are offering a bonus for it. It is not a condition of using the app: credits you hold can be spent whether or not the address has been verified. See section 11.
You can delete your account from the app's settings. Deletion is permanent and cannot be undone. See section 13.
4. Your Content
"Your Content" means the photos you upload, your avatar, the styles you select, the images FunnyFace generates from your photos, and the records of what you generated.
You keep ownership of the photos and content you upload. By using FunnyFace, you grant us a non-exclusive, worldwide, royalty-free licence, transferable to the service providers we need in order to operate, to store, transmit, process, modify, generate from, display, make available for download, and support that content.
This licence exists only so that we can provide, maintain, secure, and improve the Service, except where the law permits or requires otherwise.
5. Your Responsibility for Uploaded Photos
You confirm that you have the legal right to upload and process each photo you put into FunnyFace. If a photo shows another person's face, likeness, property, artwork, trademark, or content, you are responsible for having the rights, consent, or other lawful basis you need to use it.
FunnyFace does not verify ownership of or consent for individual uploads. The fact that we do not screen content in advance does not reduce your responsibility for what you use. To the extent permitted by law, you are responsible for claims, losses, or costs caused by your unlawful upload, generation, sharing, or use of content.
6. AI Processing and Results
FunnyFace sends your photo and the style you selected to third-party AI service providers, which generate the result. Those providers may be model providers, AI gateways, or other intermediaries, and the provider set may change for quality, capacity, resilience, pricing, and availability reasons.
Provider retention, sub-processing, training use, and routing are governed by the provider's own terms, policies, and configuration. We do not promise that any particular AI provider will always be used, or that a provider will keep offering the same terms or performance.
AI output may be inaccurate, may differ from what you expected, and may be delayed, fail, or be refused either by our systems or by a provider's.
AI-generated output is not advice, not proof of identity, not evidence of any event, and carries no guarantee of accuracy. You are responsible for how you use, share, or publish images generated with FunnyFace.
7. Use of Generated Images
Except where restricted by law, by the rights of others, by an AI provider's terms, or by these Terms, you may use images you generate for personal or commercial purposes.
You are responsible for making sure that use does not infringe anyone's privacy, likeness, publicity, copyright, trademark, or other rights.
8. Prohibited Content and Conduct
You may not use FunnyFace to upload, generate, store, share, or attempt to generate content that:
- Breaks the law or violates the rights of others;
- Uses another person's photo without appropriate rights or consent;
- Sexualises, exploits, abuses, or otherwise unlawfully involves children;
- Is nude, pornographic, sexually exploitative, or sexually harassing;
- Depicts extreme violence, self-harm, threats, hatred, discrimination, or harassment;
- Impersonates, defrauds, manipulates, or seriously misleads other people;
- Infringes copyright, trademark, privacy, publicity, or other intellectual property rights;
- Attempts to damage, scan, reverse engineer, spam, abuse the credit system, circumvent technical limits, or otherwise interfere with our systems.
FunnyFace does not currently scan or moderate all content before processing it. We and our AI providers may nonetheless refuse to process, block, remove, investigate, or restrict content or accounts where we find or suspect a violation of these Terms, of safety policies, of a provider's terms, or of the law.
9. Public Figures, Celebrities, and Political Content
FunnyFace edits photos you upload; it is not designed as a tool for generating images of real people from text alone. If you upload a photo of a celebrity, a public figure, or political content, you still need the legal right to use that photo, and you remain responsible for how you use the result.
You may not use FunnyFace to defraud, to impersonate, to create the impression that someone said or did something they did not, or to violate anyone's likeness, publicity, or privacy rights, or applicable law.
10. Reporting Content and Takedown Requests
FunnyFace has no public gallery, feed, or sharing feature. Images you generate are visible to you, and to anyone you choose to send them to after downloading them.
If you believe someone has uploaded a photo of you without your permission, that AI-generated content is offensive or violates these Terms, or that content processed through FunnyFace infringes your rights, use any in-app reporting tool available to you or contact support@funny-face.org with enough detail to identify the content and the right you are asserting. We will review the report and, where appropriate, remove content, suspend an account, or take other action described in section 18.
11. Credits and Purchases
FunnyFace is free to download and free to sign up for. Access to generation is metered with two separate credit wallets:
- Credits. Used for standard generation. Credits do not expire: what you hold stays until you spend it. You receive credits when you create your account, and you can buy more inside the app. The amounts we grant are settings we can change, and we do not promise a particular number; the app shows you what you hold.
- Fast credits. Used for generation on the fast queue. These do not expire either. There is currently no way to obtain them in the app, and they are not for sale.
Standard generation costs 1 credit. Fast generation costs 1 fast credit. Neither wallet pays for the other's generation: an account out of credits does not fall back to its fast credits, and an account out of fast credits does not fall back to its credits. Allowances, credit amounts, queue behaviour, and the conditions attached to them may change over time.
What is for sale, and what is not. The app offers three credit packs — 10, 25, and 40 credits — as one-time in-app purchases. Each total already includes a bonus of 1, 6, and 11 credits respectively; the bonus comes with every purchase of that pack and is not added on top of the total. There is no subscription and nothing renews. A purchase buys that number of credits and nothing else: no plan, no tier, no unlimited generation, and no fast credits. If your account already has unlimited standard generation, the packs are not offered to you, because there would be nothing for bought credits to pay for.
How payment works. Payment is taken by Apple on the App Store, or by Google on Google Play, from the payment method on your store account and under that store's terms. The store shows you the price in your own currency before you confirm, and that price is the price. We never receive your card, bank, or billing details, and we never see the payment itself: the store tells our servers that a purchase happened and which product it was for. A purchase is subject to your store account's own settings, including any family or parental purchase controls.
When the credits arrive. The app hands the store's record of the purchase to our servers, our servers check it directly with Apple or Google, and the credits are added once the store confirms the payment. That is normally immediate. Some payment methods on Google Play settle later, and a purchase can stay pending until the payment completes; the credits are added when it does, whether or not the app is open at that moment. Credits go to the account that was signed in when the purchase was made, and stay with that account. Credits are never granted by the app on your device — only our servers add them, and only after the store has confirmed the payment.
Credits are not money. They have no cash value, cannot be transferred between accounts, and cannot be sold, exchanged, or converted back into money. They are an allowance for generating images in this app.
FunnyFace shows no advertisements. If we introduce advertising or subscription plans in the future, we will update these Terms before doing so.
12. Refunds
Two different things can be refunded, and they work differently: a credit charged inside the app, and money you paid a store for a credit pack.
A credit charged for a generation. If a generation fails because of a processing error, a timeout, or a system fault, the credit that was charged may be returned automatically.
If you cancel a generation while it is still waiting to start, the credit is returned. Once it has started, cancelling it does not return the credit. Deleting an image after it has been produced does not return the credit.
A credit that was charged and not used is returned in full, from either wallet, whichever day it was spent on. Neither wallet resets, so there is no boundary a refund can fall the wrong side of.
Money you paid for a credit pack. We do not take that payment and we cannot refund it. A refund request goes to Apple or to Google, through the store you bought from, and that store decides it under its own policy and the consumer law that applies to you. Write to support@funny-face.org if you want help making the request, or if credits you paid for have not arrived.
What a refunded purchase does to your balance. When Apple or Google tells our servers that a purchase was refunded, we take the credits that purchase delivered, bonus included, back out of your balance. If you have already spent some of them, we take back what is there and stop at zero: a balance is never made negative, we do not ask you to pay the difference back, and we do not hold it against your account or your future credits. A person reviews what could not be recovered and, in the ordinary case, nothing further happens. If the store later reverses the refund, we put back exactly the number of credits we took, and no more. A refunded purchase is never delivered again, including if its original receipt is presented to us later.
13. Content Deletion and Account Deletion
You can delete individual images, or your whole account, from the app where the corresponding feature is available.
Deleting your account requires a recent sign-in. If you have not signed in recently, the app will ask you to sign in again before it will delete the account. This protects you against someone deleting your account from a device you left unlocked.
When you delete your account, we permanently delete the account and the data attached to it in our systems, including the photos you uploaded and saved, the images we generated for you, your avatar, your generation and download history, your devices and their notification tokens, and your credit balances and credit history.
Two exceptions apply, and we state them explicitly rather than relying on general language:
- Your Firebase sign-in record is deleted on a best-effort basis. Your account in our system is removed first, which ends access immediately. If removing the Firebase record then fails, we log the failure and the leftover record is inert — signing in again produces a clean, empty registration.
- The record of a purchase you paid for survives deletion. What a store charged you for, the credits it delivered, and any refund, stay in our systems. They have to: they are the record of a sale, and they are also what stops the same store receipt being used to claim the credits again on another account. What the record stops naming is you. The identifier it points at is unlinked from your account at deletion and never names an account again, so what remains is a purchase with no owner in our systems. Sections 10 and 11 of the Privacy Policy describe this in full.
If you signed in with Apple, the app may need you to revoke your Apple token before deleting the account, in order to meet Apple's requirements.
Beyond those exceptions, some data may persist for a limited period in backups, or where it is necessary for security, fraud prevention, dispute resolution, or legal compliance.
14. Privacy
How we collect, use, store, and share data is described in the FunnyFace Privacy Policy. Where the Privacy Policy describes choices, permissions, or consent, those are handled through the app, your device, the app stores, or direct contact with us as described there.
15. Changes, Interruptions, and Discontinuation
We may change, add, remove, suspend, or discontinue part or all of the Service, including credits, AI providers, features, technical limits, and operating policies.
We try to keep the Service stable, but we do not guarantee that it will run without interruption, without error, without data loss, without delay, or that it will always produce the result you expected.
FunnyFace is operated by an individual developer, and we may one day stop operating it entirely. If we discontinue the Service, we will try to give reasonable advance notice in the app, so that you can download any images you want to keep, and we will delete user data from our systems afterwards. Do not rely on FunnyFace as the only copy of an image that matters to you.
16. Disclaimers
To the extent permitted by law, FunnyFace is provided "as is" and "as available". We make no warranty that the Service will meet your needs, run uninterrupted, be perfectly secure, be perfectly accurate, or be free of errors.
You use AI output at your own risk, particularly when publishing, sharing, using it commercially, using it for advertising, using it to identify a person, or using it for any sensitive purpose.
17. Limitation of Liability
To the extent permitted by law, FunnyFace and its developer are not liable for indirect, incidental, special, or consequential damages, for lost profits, lost data, or lost reputation, or for claims arising from your use of or inability to use the Service.
To the extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of 5 USD or its equivalent, and the total amount you paid for FunnyFace in-app purchases in the twelve months before the claim.
Some jurisdictions do not allow certain exclusions or limitations of liability. Where that is the case, the limits above apply only as far as the law allows, and mandatory consumer protections where you live are unaffected.
18. Suspension and Termination
We may suspend, restrict, or terminate your access, refuse to process generations, remove content, or take other appropriate measures if we believe you have violated these Terms, the Privacy Policy, safety policies, a third-party provider's terms, or the law.
If we terminate your account, your content is deleted from our systems in the same way as when you delete the account yourself, described in section 13. Where an investigation or a legal obligation requires it, we may retain specific records for as long as necessary before deleting them.
You may stop using FunnyFace at any time, and may delete your account from within the app.
19. Governing Law and Disputes
We would rather resolve any problem by talking to you first. For questions, complaints, or disputes, contact support@funny-face.org.
These Terms are governed by the laws of Vietnam, and the courts of Vietnam have jurisdiction over disputes arising from them. This does not remove any mandatory consumer protection that applies where you live.
20. Language
These Terms are published in English and Vietnamese. The English text is the source from which other language versions are prepared.
For users in Vietnam, the Vietnamese version governs the relationship between you and FunnyFace. Where the two versions differ for any other user, the English version applies.
21. Changes to These Terms
We may update these Terms from time to time. Each version carries the version identifier shown at the top of this document, and we record which version you accepted when you created your account.
Where a change is significant, we will try to notify you in the app or by another appropriate means, and may ask you to accept the new version. Where the law requires consent or a new acceptance, we will ask for it before the change applies to you. Continuing to use the Service after updated Terms take effect means you accept them.
22. General
If any part of these Terms is found to be invalid or unenforceable, that part is limited or removed to the minimum extent necessary, and the rest of the Terms remain in force.
If we do not enforce a provision of these Terms straight away, that is not a waiver of our right to enforce it later.
These Terms are the whole agreement between you and FunnyFace regarding the Service. The Privacy Policy explains our privacy practices and is incorporated into these Terms only where these Terms expressly rely on it.
