1. Overview

FunnyFace is an AI photo generation and editing app. It lets you upload a photo, choose a style, generate a new image, keep results in the app, and download them to your device.

In this document, "FunnyFace", "we", "us", or "the Service" means the FunnyFace mobile app together with the servers, website, features, and related services behind it, operated by an individual developer:

By downloading, accessing, or using FunnyFace, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old to use FunnyFace. FunnyFace is not designed for and is not directed at children under 16, and we do not knowingly allow accounts for people under that age.

FunnyFace is offered in selected countries only. The Service is not offered in, and is not intended for users located in, the European Economic Area, the United Kingdom, or Switzerland.

3. Accounts, Sign-In, and Consent

You can sign in to FunnyFace with Apple, Google, or email. Authentication is handled through Firebase. You are responsible for keeping your device and sign-in credentials secure, and for activity that takes place in your account.

When you create an account, you must give two separate confirmations before the account can be created:

  1. That you accept these Terms of Service and the Privacy Policy.
  2. That you consent to FunnyFace processing the photos you upload in order to generate new images.

We record the date, time, and document version for each confirmation. Without both, no account is created.

If your account has an email address, that address must be verified before daily credits are granted. Accounts signed in through a provider that supplies no email address are not subject to this requirement.

You can delete your account from the app's settings. Deletion is permanent and cannot be undone. See section 13.

4. Your Content

"Your Content" means the photos you upload, your avatar, the styles you select, the images FunnyFace generates from your photos, and the records of what you generated.

You keep ownership of the photos and content you upload. By using FunnyFace, you grant us a non-exclusive, worldwide, royalty-free licence, transferable to the service providers we need in order to operate, to store, transmit, process, modify, generate from, display, make available for download, and support that content.

This licence exists only so that we can provide, maintain, secure, and improve the Service, except where the law permits or requires otherwise.

5. Your Responsibility for Uploaded Photos

You confirm that you have the legal right to upload and process each photo you put into FunnyFace. If a photo shows another person's face, likeness, property, artwork, trademark, or content, you are responsible for having the rights, consent, or other lawful basis you need to use it.

FunnyFace does not verify ownership of or consent for individual uploads. The fact that we do not screen content in advance does not reduce your responsibility for what you use.

6. AI Processing and Results

FunnyFace sends your photo and the style you selected to third-party AI service providers, which generate the result. AI output may be inaccurate, may differ from what you expected, and may be delayed, fail, or be refused either by our systems or by a provider's.

AI-generated output is not advice, not proof of identity, not evidence of any event, and carries no guarantee of accuracy. You are responsible for how you use, share, or publish images generated with FunnyFace.

7. Use of Generated Images

Except where restricted by law, by the rights of others, by an AI provider's terms, or by these Terms, you may use images you generate for personal or commercial purposes.

You are responsible for making sure that use does not infringe anyone's privacy, likeness, publicity, copyright, trademark, or other rights.

8. Prohibited Content and Conduct

You may not use FunnyFace to upload, generate, store, share, or attempt to generate content that:

FunnyFace does not currently scan or moderate all content before processing it. We and our AI providers may nonetheless refuse to process, block, remove, investigate, or restrict content or accounts where we find or suspect a violation of these Terms, of safety policies, of a provider's terms, or of the law.

9. Public Figures, Celebrities, and Political Content

FunnyFace edits photos you upload; it is not designed as a tool for generating images of real people from text alone. If you upload a photo of a celebrity, a public figure, or political content, you still need the legal right to use that photo, and you remain responsible for how you use the result.

You may not use FunnyFace to defraud, to impersonate, to create the impression that someone said or did something they did not, or to violate anyone's likeness, publicity, or privacy rights, or applicable law.

10. Reporting Content and Takedown Requests

FunnyFace has no public gallery, feed, or sharing feature. Images you generate are visible to you, and to anyone you choose to send them to after downloading them.

If you believe someone has uploaded a photo of you without your permission, or that content processed through FunnyFace infringes your rights, contact support@funny-face.org with enough detail to identify the content and the right you are asserting. We will review the report and, where appropriate, remove content, suspend an account, or take other action described in section 18.

11. Credits and Free Access

FunnyFace is currently free to use. There are no in-app purchases, subscriptions, or paid plans, and no payment is taken through the app.

Access to generation is metered with credits:

Standard generation costs 1 daily or balance credit. Fast generation costs 1 fast credit. Allowances, credit amounts, queue behaviour, and the conditions attached to them may change over time.

If we introduce paid plans or in-app purchases in the future, we will update these Terms before doing so.

12. In-App Credit Refunds

If a generation fails because of a processing error, a timeout, or a system fault, the credit that was charged may be returned automatically.

If you cancel a generation while it is still waiting to start, the credit is returned. Once it has started, cancelling it does not return the credit. Deleting an image after it has been produced does not return the credit.

These rules govern credits inside the app.

13. Content Deletion and Account Deletion

You can delete individual images, or your whole account, from the app where the corresponding feature is available.

Deleting your account requires a recent sign-in. If you have not signed in recently, the app will ask you to sign in again before it will delete the account. This protects you against someone deleting your account from a device you left unlocked.

When you delete your account, we permanently delete the account and the data attached to it in our systems, including the photos you uploaded and saved, the images we generated for you, your avatar, your generation and download history, your devices and their notification tokens, and your credit balances and credit history.

Two exceptions apply, and we state them explicitly rather than relying on general language:

If you signed in with Apple, the app may need you to revoke your Apple token before deleting the account, in order to meet Apple's requirements.

Beyond those two exceptions, some data may persist for a limited period in backups, or where it is necessary for security, fraud prevention, dispute resolution, or legal compliance.

14. Privacy

How we collect, use, store, and share data is described in the FunnyFace Privacy Policy. By using the Service you also agree to the handling described there.

15. Changes, Interruptions, and Discontinuation

We may change, add, remove, suspend, or discontinue part or all of the Service, including credits, AI providers, features, technical limits, and operating policies.

We try to keep the Service stable, but we do not guarantee that it will run without interruption, without error, without data loss, without delay, or that it will always produce the result you expected.

FunnyFace is operated by an individual developer, and we may one day stop operating it entirely. If we discontinue the Service, we will try to give reasonable advance notice in the app, so that you can download any images you want to keep, and we will delete user data from our systems afterwards. Do not rely on FunnyFace as the only copy of an image that matters to you.

16. Disclaimers

To the extent permitted by law, FunnyFace is provided "as is" and "as available". We make no warranty that the Service will meet your needs, run uninterrupted, be perfectly secure, be perfectly accurate, or be free of errors.

You use AI output at your own risk, particularly when publishing, sharing, using it commercially, using it for advertising, using it to identify a person, or using it for any sensitive purpose.

17. Limitation of Liability

To the extent permitted by law, FunnyFace and its developer are not liable for indirect, incidental, special, or consequential damages, for lost profits, lost data, or lost reputation, or for claims arising from your use of or inability to use the Service.

To the extent permitted by law, our total liability for all claims relating to the Service will not exceed 50 USD or its equivalent. FunnyFace is currently provided free of charge, so no amount has been paid to us in respect of the Service.

Some jurisdictions do not allow certain exclusions or limitations of liability. Where that is the case, the limits above apply only as far as the law allows, and mandatory consumer protections where you live are unaffected.

18. Suspension and Termination

We may suspend, restrict, or terminate your access, refuse to process generations, remove content, or take other appropriate measures if we believe you have violated these Terms, the Privacy Policy, safety policies, a third-party provider's terms, or the law.

If we terminate your account, your content is deleted from our systems in the same way as when you delete the account yourself, described in section 13. Where an investigation or a legal obligation requires it, we may retain specific records for as long as necessary before deleting them.

You may stop using FunnyFace at any time, and may delete your account from within the app.

19. Governing Law and Disputes

We would rather resolve any problem by talking to you first. For questions, complaints, or disputes, contact support@funny-face.org.

These Terms are governed by the laws of Vietnam, and the courts of Vietnam have jurisdiction over disputes arising from them. This does not remove any mandatory consumer protection that applies where you live.

20. Language

These Terms are published in English and Vietnamese. The English text is the source from which other language versions are prepared.

For users in Vietnam, the Vietnamese version governs the relationship between you and FunnyFace. Where the two versions differ for any other user, the English version applies.

21. Changes to These Terms

We may update these Terms from time to time. Each version carries the version identifier shown at the top of this document, and we record which version you accepted when you created your account.

Where a change is significant, we will try to notify you in the app or by another appropriate means, and may ask you to accept the new version. Continuing to use the Service after updated Terms take effect means you accept them.

22. General

If any part of these Terms is found to be invalid or unenforceable, that part is limited or removed to the minimum extent necessary, and the rest of the Terms remain in force.

If we do not enforce a provision of these Terms straight away, that is not a waiver of our right to enforce it later.

These Terms, together with the Privacy Policy, are the whole agreement between you and FunnyFace regarding the Service.
